The General Terms and Conditions of Contracting regulate the distance selling relationship between PRIMA-DERM SL and the user or client, in accordance with legal stipulations, particularly Law 7/1998, of April 13, on General Conditions of Contracting; Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users; current and applicable regulations on Personal Data Protection; Law 7/1996, of January 15, on Retail Trade Regulation; and Law 34/2002, of July 11, on Information Society Services and Electronic Commerce.
PRIMA-DERM SL reserves the right to make modifications it deems appropriate to the General Conditions without prior notice. These modifications may be made through its websites by any legally admissible means and shall be binding for as long as they are published on the website until validly replaced by subsequent modifications. However, PRIMA-DERM SL reserves the right to apply, in certain cases, Specific Contracting Conditions instead of these General Conditions when deemed appropriate, announcing them in a timely manner. The website’s purpose is to offer cosmetic and perfume products.
The duration of the contract will be linked to the delivery of the product, without prejudice to the right of withdrawal. By using the website or purchasing products, the user or customer expressly declares to know, understand, and accept the terms of use and these general contracting conditions. PRIMA DERM SL is responsible for any lack of conformity of all products offered on the website for a period of two years from delivery. Prices
All products indicate the selling price in Euros and do not include Value Added Tax (VAT). If any other tax is applicable, it will be indicated (such as IGIC or IPSI).
Delivery and Shipping Costs
All orders will be processed and shipped the next day after their reception.
Deliveries will be made from Monday to Friday; however, if for any reason the delivery date cannot be met, the customer will be informed of this circumstance. In this way, the customer will be given the option to proceed with the purchase, being informed of the new delivery date, or to cancel the order with a full refund of the price paid.

Order delivery
Orders will be delivered to the address designated by the customer at the time of purchase. Therefore, PRIMA-DERM SL assumes no responsibility if the delivery cannot be made due to incorrect or incomplete data provided. In the event that the order is rejected by the recipient or the recipient is absent, PRIMA-DERM SL assumes no responsibility and reserves the right to charge the customer 100% of the value of the order.
For deliveries designated to Hospitals, Hotels, Public Institutions, and other places where there are restrictions for general public access, orders will be delivered to the reception or similar location. In this case, an attempt will be made to obtain the signature of the receptionist or similar, and the order will be considered delivered, with no responsibility assumed for events occurring after delivery.
In these cases, please provide as much information as possible, such as the department name, room number, floor number, recipient’s full name, etc.
Payment methods and order execution

If the amount of a purchase has been fraudulently or improperly charged using a payment card number, the cardholder may demand the immediate cancellation of the charge. In this case, the corresponding debit and refund entries in the supplier’s and cardholder’s accounts will be made as soon as possible.
However, if the purchase has indeed been made by the cardholder and the demand for reimbursement is not the result of exercising the right of withdrawal or resolution and, therefore, has improperly demanded the cancellation of the corresponding charge, the cardholder will be obligated to compensate PRIMA DERM SL for the damages and losses incurred as a result of such cancellation.

It is very important that when making the transfer, you indicate in the subject the order number, as well as your name and surname, and make the transfer within 3 days after the date of order confirmation to validate it.

PURCHASE CONFIRMATION – If you purchase with Scalapay, you will receive your order and pay in 3 installments. You confirm that the installments will be sold to and purchased by Retail Installments SPV 1 Limited, to the related parties and their beneficiaries, and hereby unconditionally and irrevocably authorize and consent to this sale.
If you wish, you can send us the bank transfer receipt by email to info@prima-derm.com. However, please note that the order will not be considered effective until our administration department receives bank confirmation of the transfer.
We would like to remind you that payment must be made in EUROS and that any exchange and bank fees are your responsibility.
In the case of bank transfers made from outside Spain, it is very important that when ordering the transfer, you always instruct your bank to bear the fees at the origin, including any bank charges and expenses corresponding to your institution. If this is not done, PRIMA-DERM SL may withhold the shipment of your order until the full amount is received.
Any exchange and bank fees are borne by the customer.
The availability of products offered by PRIMA-DERM SL may vary depending on customer demand. Although PRIMA-DERM SL updates its stock periodically, the product requested by the customer may be out of stock at that time. In the event of non-execution due to unavailability, PRIMA-DERM SL will notify the customer via email as soon as this situation is known. The period of this communication will not exceed 30 days under any circumstances.
PRIMA-DERM SL may offer the customer the double option of: providing a product with similar characteristics or of superior quality without any price increase, or, unless justified and demonstrable reasons are provided by PRIMA-DERM SL within this same period, refunding the amounts paid for the canceled order.
Right of withdrawal
The buyer shall have a period of fourteen calendar days to withdraw, starting from the day the customer receives the product, without any penalty and without indicating the reasons.
The exercise of the right of withdrawal must be made by notification through a phone call to 936811650, by addressing an email to info@prima-derm.com, sending your written notice to our address POL IND LES MARINES CARRER CONEIXEMENT 3 08850, GAVÀ (BARCELONA), or through the withdrawal form.
As established in article 103 of Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users, the supply of services or goods made to the consumer’s specifications or clearly personalized, or which, by their nature, cannot be returned or may deteriorate or expire rapidly, are exempt from withdrawal.
The return
The client must return or deliver the product directly to PRIMA-DERM SL at the address POL IND LES MARINES CARRER CONEIXEMENT 3 08850, GAVA (BARCELONA), without undue delay, and in any case within fourteen calendar days from the date the right of withdrawal from the contract is formalized. The deadline will be considered met if the client returns the product before the end of this period.
The client will bear the direct cost of returning the product, which amounts to 6€ per return for the mainland and 10€ for the Balearic Islands. Returns are not accepted for international orders, Canary Islands, Ceuta, and Melilla.
In any case, the products to be returned must be in perfect condition, unused, and in their original packaging. To avoid any issues during transport, please ensure that the package is properly protected and sealed. Once received, we will check its condition. Once we verify that both the item(s) and any possible components, accessories, promotional gifts, and documentation are complete and in perfect condition, we will proceed to refund the money paid.
Once the merchandise is received in our warehouses, returns will be processed within the next 7 business days following its receipt. When the condition of the products has been checked, the refund of their amount will be processed according to the payment method chosen by the client at the time of purchase, provided that they meet the aforementioned requirements. The shipping costs paid at the time of purchase are non-refundable.

The refund of the amounts received from the customer will be made using the same payment method used by the customer, unless otherwise agreed.

PRIMA-DERM SL may withhold the refund until the product, subject to withdrawal, has been received, or until the customer provides proof of return of the same, whichever condition is met first.
Return of the defective product
In case the product is not in good condition and the reasons attributable to this are not the customer’s fault, the customer will have the right to return the product, informing PRIMA-DERM SL of the reason for the return through any of the means provided in these terms of service, and at no cost to the customer. This return due to a defect or poor condition of the product will not be considered a right of withdrawal.
If any damage has occurred to the items sent, it must be notified to the Customer Service Department either via email at pedidos@prima-derm.com or by phone at 93 681 16 50.
When contacting our Customer Service, you must provide the order number and keep the shipping box, packaging materials, and damaged items. Our Customer Service team will contact the carrier to collect and inspect the damaged package, as well as replace the defective items.
PRIMA-DERM SL undertakes to bear the cost of the return and to replace the product with a new one according to the conditions accepted at the time of sale.
Incorrect order
In case of an error or inaccuracy in the products received from the order, it must be reported within a maximum period of 72 hours from the receipt of the package. This issue should be communicated to our Customer Service via email at pedidos@prima-derm.com or by phone at 93 681 16 50. Please have the order number or delivery note (attached to the order) at hand to facilitate the management procedures.
PRIMA-DERM SL will directly handle the collection of the incorrect product and/or the replacement of the missing product.
Jurisdiction
Likewise, PRIMA-DERM SL reserves the right to take civil or criminal action it deems appropriate for the misuse of its website and contents or for non-compliance with these conditions.
The relationship between the user and the provider shall be governed by the current regulations applicable in Spanish territory. In the event of any dispute, the parties may submit their conflicts to arbitration or resort to ordinary jurisdiction in accordance with the rules on jurisdiction and competence in this regard.
